General Terms and Conditions for the Use of Web Solutions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Welcome to https:\/\/www.wizart.si\/ (the \u201cWebsite\u201d), provided by IVH d.o.o. (the \u201cCompany\u201d). Your use of the Website is subject to the following terms and conditions at all times, and by using the Website you are deemed to have accepted them. Before using the Website, please read these terms and conditions carefully and make sure you understand them. If you do not agree, you must leave the Website immediately.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

I. GENERAL PROVISIONS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

Article 1<\/b><\/h5>

Web solutions include website development and other web-based solutions.<\/p>

The web solutions are entirely the product of IVH d.o.o.'s own expertise and development (hereinafter the \u201cProvider\u201d), which holds all copyright and related rights in them.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

Article 2<\/b><\/h5>

The selected web solutions will be available to the Client within three business days of completion of the implementation project and receipt of payment for implementation and the subscription. Payment for implementation and the subscription establishes a contract between the Provider and the Client, and both parties are bound by these terms.<\/p>

By paying the subscription fee, the Client acquires the right to use the web solutions and their graphic design for the period covered by the subscription. All data and information collected in the web solution system during its use belong to the Client.<\/p>

If the Client fails to renew the subscription despite expiry notices, the website will be automatically deactivated after 30 days. If it is not renewed within 3 months of deactivation, the Provider may unilaterally terminate the contract and delete the Client's user account and website, together with all content and data, without any obligation to the Client.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

II. CLIENT RIGHTS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t
Article 3<\/b><\/h5>

Each payment or renewal of the web solutions subscription grants the Client the following rights for the subscription period:<\/p>

  • free telephone\/email support upon payment of the annual subscription, to the extent specified in the current price list, proposal, or contract,<\/li>
  • use of the selected web solutions (the Client acquires only a right of use and no other copyright),<\/li>
  • hosting of the selected web solutions to the extent specified in the proposal or contract.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t

    III. PROCESSING OF PERSONAL DATA<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    Article 4<\/b><\/h5>

    The Provider processes personal data in accordance with applicable legislation. The processing methods and the Clients' related rights are set out in IVH d.o.o.'s Privacy Policy, which forms an integral part of these General Terms and Conditions for the Use of Web Solutions and is available at this link.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    IV. SUBSCRIPTION TERM<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    Article 5<\/b><\/h5>

    The Client pays for a web solutions subscription for the agreed period. The system notifies the Client of its expiry:<\/p>

    • 15 days before expiry,<\/li>
    • 8 days before expiry,<\/li>
    • on the expiry date, and<\/li>
    • 8 days after expiry.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      If the Client does not renew the subscription for the selected period within 8 days of expiry, the web solution, including the hosting package and email services, may stop working until the next payment is received. Payments are recorded within two business days of receipt at the latest.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      V. PROVIDER LIABILITY<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

      Article 6<\/b><\/h5>

      The Provider is not responsible for content on Clients' web solutions, its origin, copyright, or any consequences arising from it. At the request of a public authority, another competent person, or a lawful holder of economic copyright, the Provider will remove content from the Client's website. In the event of repeated infringements, the Provider will delete the Client's user account without refunding the subscription fee.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      VI. CLIENT OBLIGATIONS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

      Article 7<\/b><\/h5>

      The Client must maintain the security of their system at all times and must not upload questionable or harmful files to the server or send spam emails. In such cases, the Provider will remove content from the Client's website. In the event of repeated violations, the Provider will delete the Client's user account without refunding the subscription fee.<\/p>

      Any use of data, images, text, or other materials forming part of wizart.si is prohibited. Copying, distributing, or otherwise using any of these materials without the Provider's prior knowledge and permission is prohibited.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      VII. SERVER CAPACITY AND LIMITATION OF LIABILITY<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

      Article 8<\/b><\/h5>

      The Provider supplies server capacity, meaning hosting for the web solutions, as part of the web solutions subscription package.<\/p>

      If the server is unavailable for more than 24 hours and this causes business losses to the Client, the Provider's liability for damages is limited to the Client's paid annual subscription fee. Otherwise, the Provider is not liable for the resulting damage.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      VIII. TERMINATION OF THE RELATIONSHIP<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

      Article 9<\/b><\/h5>

      Either the Client or the Provider may terminate the relationship at any time, without giving a reason, by written notice with a 30-day notice period.<\/p>

      If the Provider terminates the relationship, the Provider must refund the Client the proportion of the paid subscription fee corresponding to the remaining subscription period.<\/p>

      If the Client terminates the relationship, the Provider is not required to refund the proportion of the paid subscription fee corresponding to the remaining subscription period. If the Client terminates during the project, for example due to a change in business activity, the Client must pay the full implementation amount specified in the proposal or contract.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      IX. OTHER PROVISIONS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

      Article 10<\/b><\/h5>

      The first two reminders for unpaid invoices are free of charge. Each subsequent email reminder costs EUR 15, and each postal reminder costs EUR 45. Prices exclude VAT.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      Client Support<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      The web solutions subscription proposal specifies the amount of support included in the subscription fee. This depends on the selected solutions and is described in detail in the proposal.<\/p>\n
